The report from the Attorney General's Fair Labor Division highlights enforcement actions and violation trends within the construction industry for the year 2024. A total of 179 citations were issued against 85 construction companies for violations related to state wage and hour laws, misclassification, and prevailing wage laws. These enforcement actions resulted in over $1.1 million in restitution for more than 1,167 employees, alongside $587,000 in penalties paid to the General Fund. The construction industry was notably the second most cited sector, accounting for 16 percent of all enforcement actions, with the most significant violations being related to overtime compensation, timely payment, prevailing wage, and misclassification of workers.

In addition to the citations, the Division sent 22 letters to state and local awarding authorities regarding prevailing wage violations on their projects and made 103 referrals for payroll fraud to the Massachusetts Council on the Underground Economy and other agencies. This proactive approach aims to combat insurance fraud and tax evasion by employers in the construction sector. The report underscores the ongoing efforts of the Fair Labor Division to ensure compliance with labor laws and protect workers' rights in Massachusetts.
