(accompanied by bill, House, No. 4081) of Paul A. Schmid, III (by vote of
the town) that the town of Acushnet be authorized to continue the
employment of the call deputy fire chief of said town, reports
recommending that the accompanying bill (House, No. 5121) ought to
pass [Local Approval Received].

An Act authorizing the town of Acushnet to continue the employment of Call Deputy Fire Chief.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
1 SECTION 1. Notwithstanding any general or special law to the contrary, David Makuch,
2 the Call Fire Deputy Chief of the Town of Acushnet, may continue to serve in that position until
3 reaching age 70, the date of his retirement, or the date he is relieved of his duties by the Town of
4 Acushnet Board of Selectmen at its discretion, whichever occurs first; provided, however, that he
5 is mentally and physically capable of performing the duties of his office.
6 The Board of Selectmen may, at the Town's own expense, require that David Makuch be
7 examined annually by a physician designated by the Town, to determine such physical and
8 mental capability to perform the duties of his office.
9 No further deductions shall be made from the regular compensation of David Makuch
10 under chapter 32 of the General Laws for any service subsequent to his reaching 65 years of age
11 and, upon retirement, David Makuch shall receive a superannuation retirement allowance equal
12 to that which he would have been entitled had he retired at 65 years of age.
13 SECTION 2. This act shall take effect upon its passage.
