whom was referred the petition (accompanied by bill, House, No. 4796) of
James C. Arena-DeRosa (by vote of the town) that the town of Sherborn
be authorized to convert one license for the sale of wine and malt
beverages not to be drunk on the premises to a license for the sale of all
alcoholic beverages not to be drunk on the premises, reports
recommending that the accompanying bill (House, No. 4990) ought to
pass [Local Approval Received].

An Act authorizing the town of Sherborn to grant 1 additional license for the sale of all alcoholic
beverages not to be drunk on the premises.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2 licensing authority of the town of Sherborn may grant an additional license for the sale of all
3 alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to
4 Art's Specialties, LLC located at 11 South Main Street in the town of Sherborn. The license shall
5 be subject to all of said chapter 138 except said section 17.
6 (b) The licensing authority shall not approve the transfer of the license granted under this
7 section to any other location but it may grant the license to a new applicant at the same location
8 if the applicant files with the licensing authority a letter from the department of revenue and a
9 letter from the department of unemployment assistance indicating that the license is in good
10 standing with those departments and that all applicable taxes, fees and contributions have been
11 paid.
12 (c) If the licensee terminates or fails to renew a license granted under this section or any
13 such license is cancelled, revoked or no longer in use, it shall be returned physically, with all the

14 legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the
15 licensing authority may, within 3 years after such return, then grant the license to a new applicant
16 at the same location under the same conditions as specified in this section, otherwise such license
17 shall dissolve.
18 (d) A license granted under this section shall be issued within 1 year after the effective
19 date of this act; provided, however, that a license originally granted within that time period may
20 be granted to a new applicant under subsections (b) and (c) thereafter.
21 SECTION 2. Upon issuance of the license authorized in section 1, the licensee shall
22 return physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the
23 licensing authority, its license for the sale of wine and malt beverages not to be drunk on the
24 premises under section 15 of chapter 138.
25 SECTION 3. This act shall take effect upon its passage.
