Senate Bill No. by Senator Selders amends the Civil Code regarding the prescriptive periods for disavowal of paternity actions. The bill changes the time limit for a husband to disavow paternity from one year to twelve years, starting from the child's birth or from when the husband knew or should have known he may not be the biological father, with a cap that the action cannot extend beyond the child's twelfth birthday. Additionally, if the husband lived separately from the mother for the 300 days before the child's birth, the prescription period does not begin until he is notified in writing that he is being claimed as the father.

The bill also modifies the time frame for a man to establish paternity. It extends the period from one year to twelve years from the child's birth for cases where the child is presumed to be the child of another man. If the mother deceived the father regarding paternity, the action must be initiated within one year of the father becoming aware of his paternity or within twelve years from the child's birth, whichever comes first. The bill maintains that all actions must be initiated no later than one year from the child's death, and these time periods are designated as peremptive. The changes are set to take effect on August 1, 2026.
