Senate Bill No. 385, introduced by Senator Harris, aims to amend and reenact various sections of existing law regarding the New Orleans City Park Improvement Association. The bill updates the membership structure of the board of commissioners by allowing the senator and representative for the district in which New Orleans City Park lies to appoint designees to the board. Additionally, it clarifies the authority of the board to contract with nonprofit or not-for-profit entities for the operation, care, control, and management of the park and its facilities. The bill also stipulates that any such contracted entity will not be considered an agent of the state for procurement purposes and can be named as an additional insured on the association's insurance plans.
Furthermore, the bill introduces provisions that exempt the New Orleans City Park Improvement Association from participating in the state risk management program for comprehensive general liability or workers' compensation coverage if all park employees are employed by the contracted entity, which must carry its own insurance. However, the association may still participate in the state risk management program for property insurance. The proposed changes are set to take effect on August 1, 2026.
