House Bill No. [insert number] enacts a new provision under R.S. 13:754(F)(3) that establishes an additional fee of five dollars for each document recorded with the clerk of court. This fee is designed to support the Louisiana Clerks' Remote Access Authority (LCRAA) and will be allocated as follows: the member clerk will retain fifty cents, while the remainder will be sent to the LCRAA, which will also keep fifty cents before directing the rest to the Court Modernization and Technology Fund. This fund aims to enhance cooperation with the LCRAA for statewide court electronic filing integration. Furthermore, the Louisiana Supreme Court and appellate courts are mandated to enter into cooperative agreements to create a unified filing platform for all appellate courts.
The new fee will take effect on January 1, 2027, and the LCRAA is required to report to the legislature by the start of the 2028 Regular Session on the total funds collected and the progress made towards achieving an integrated filing platform. Additionally, the provisions of this new fee will expire on August 1, 2029, unless extended by further legislative action.
