Senate Bill No. 252, known as the "Driver's License Anatomical Gift Consent Clarity Act," amends R.S. 32:410(B) to enhance the process of anatomical gift authorization on driver's licenses in Louisiana. The bill clarifies that the Department of Public Safety and Corrections (DPS) must provide information regarding anatomical donations in a neutral manner, without favoring either authorization or refusal. Applicants for a driver's license or identification card will have the opportunity to indicate their choice regarding anatomical gifts—whether to authorize, refuse, or make no selection at all. Importantly, no applicant can be compelled to make a selection as a condition for obtaining or renewing their driver's license.
Additionally, the bill retains existing provisions that require the DPS to make available information about anatomical gifts, including a statement for indicating the organs donated and any special wishes of the donor. It also specifies that if an applicant does not make a selection at the time of application or renewal, this absence will not imply authorization or refusal, nor will it revoke any prior decisions regarding anatomical gifts. The act is set to take effect on January 1, 2027, and includes a severability clause to ensure that if any part of the law is found invalid, the remaining provisions will still be enforceable.
