The bill amends and reenacts the introductory paragraph of R.S. 22:1157(D)(2) and enacts new provisions under R.S. 22:1157(A)(6) and (D)(2)(c) and (4) to establish clearer guidelines for dental reimbursement and payment methods. A key addition is the definition of "express acceptance," which refers to a clear agreement to a selected payment method, allowing for electronic acceptance through digital signatures or checkbox confirmations. The bill also specifies that dental plans must obtain express acceptance from providers when initiating or changing payment methods, such as electronic funds transfers or credit card payments.
Additionally, the bill introduces a provision stating that any violation of the express acceptance requirement will nullify the election on claim payment methodology until a new agreement is executed. The provisions of this Act will become operative on January 1, 2027, applying to any dental coverage plans issued or renewed after that date, with existing plans required to conform by January 1, 2028. The Act will take effect upon the governor's signature or after the designated period for bills to become law without signature.
