House Bill No. by Representative Mandie Landry aims to enhance consumer protection practices for individuals interacting with artificial intelligence (AI) systems. The bill introduces a new section, R.S. 51:1430, which defines "automated system" as any technology, such as chatbots or AI agents, that engages in conversation and may mislead consumers into believing they are communicating with a human. It establishes that it is considered an unfair or deceptive trade practice for any corporation, organization, or individual to engage in commercial transactions with consumers without clearly notifying them that they are interacting with an automated system.

The proposed law allows consumers who are misled by such practices to initiate civil actions against the offending parties. It stipulates that those found in violation may be liable for actual damages sustained by the consumer, along with statutory damages up to $1,000, or up to $10 million in class action cases. Additionally, the Attorney General is empowered to seek injunctive relief against violators, and civil penalties for non-compliance can reach up to $5 million. This legislation aims to ensure transparency and protect consumers from deceptive practices in the rapidly evolving landscape of AI technology.
