House Bill No. by Representative Bryant amends the Habitual Offender Law by enacting new provisions under R.S. 15:529.1. The bill establishes that individuals convicted of a third felony, where the third and two prior felonies are classified as crimes of violence but did not involve actual violence, will face a specific sentencing structure. Specifically, these offenders will receive a determinate sentence of no less than half of the longest possible sentence for a first conviction and no more than twice that length. The bill also defines "actual violence" as the use, attempted use, or threatened use of physical force against another person or property, which carries a substantial risk of physical force being used during the commission of a crime.

Additionally, the bill includes a retroactive application clause, allowing it to affect any offender who was sentenced or adjudicated prior to June 15, 2001. The proposed law retains much of the existing framework of the Habitual Offender Law while introducing these new sentencing guidelines and definitions to clarify the treatment of habitual offenders in specific circumstances.
