This bill amends R.S. 9:355.2 to clarify the applicability of laws regarding the relocation of a child. It specifies that the provisions apply when there is an intent to establish a child's principal residence outside the state or more than seventy-five miles from the other parent's domicile or the child's current residence, depending on custody arrangements. The bill also introduces a new definition for measuring distances, stating that miles shall be measured by the shortest distance accessible by motor vehicle or public ferry.
Additionally, the bill removes outdated language regarding the applicability of the subpart to custody orders issued before August 15, 1997, and clarifies that it does not apply when there is an express written agreement for relocation or when certain protective orders are in effect. The effective date for this legislation is set for January 1, 2027, and it will not apply to any ongoing litigation regarding child relocation at that time.
