The bill SB 42, proposed by Senator Edmonds, aims to prohibit the use of artificial intelligence in the creation of child sexual abuse materials, with an effective date of August 1, 2026. The proposed law expands the definition of "child sexual abuse materials" to include undeveloped film and data stored electronically that can be converted into visual images, as well as images generated by artificial intelligence that are virtually indistinguishable from real children under the age of 17. Additionally, the definition of "produce" is amended to encompass the act of causing artificial intelligence to generate such materials.
The Conference Committee Report also rejects House amendments that would have allowed the attorney general to bring civil actions for compliance and granted minors harmed by these materials a cause of action. The bill retains existing definitions and provisions while enhancing the legal framework to address the growing concern of AI-generated child exploitation materials.
