The resolution urges the Louisiana division of administration, the Patient's Compensation Fund, and the Patient's Compensation Fund Oversight Board to conduct a study on the feasibility and potential costs of implementing an electronic filing (e-filing) system for medical review panel requests, as well as an electronic payment (e-payment) system for associated filing fees. Currently, malpractice claims must be submitted through postal mail, in person, or via facsimile, and filing fees are similarly paid through traditional methods. The resolution highlights that an e-filing and e-payment system would provide a more secure, efficient, and timely process for claimants and health care providers, while also ensuring compliance with filing fee requirements.
The study is expected to assess the ability to implement these technological improvements under existing legislative authority and to evaluate any associated costs, which could potentially be incorporated as convenience fees into the filing fees. The division of administration is required to submit a written report detailing the findings, conclusions, and recommendations of the study to the legislature by December 31, 2025. The resolution also mandates that copies be sent to relevant officials, including the commissioner of administration and the executive director of the Patient's Compensation Fund.
