The bill enacts a new section, R.S. 9:1114, which establishes the "Freedom to display the flag of the United States" in Louisiana. It prohibits planned communities, condominium associations, and lessors from adopting or enforcing any rules that restrict individuals from displaying a removable, portable U.S. flag. However, the bill allows these entities to implement reasonable regulations regarding the size, time, place, and manner of flag display.
Additionally, the bill provides for civil relief in the form of injunctive relief for violations, including the possibility of recovering court costs and reasonable attorney fees if such relief is granted. The provisions of this Act will only apply to new covenants, declarations, contractual provisions, leases, or rental agreements created after the effective date of the Act.
