House Bill No. by Representative Villio appropriates $10,000 from the State General Fund for the fiscal year 2024-2025 to pay a consent judgment in the case of State Farm Mutual Automobile Insurance Company v. Herman D. Oliver and the State of Louisiana, through the Department of Transportation and Development. The judgment, signed on March 2, 2023, is to be paid for principal, interest, court costs, and expert witness fees as awarded, and it will only be paid if it is final. The bill stipulates that if there are any conflicts between the judgment and the provisions of the Act, the judgment will take precedence.
Additionally, the bill includes provisions that prohibit the accrual of interest on the judgment from the effective date of the Act. The Act will become effective upon the governor's signature or, if not signed, after the time for bills to become law without signature expires. If the governor vetoes the bill and it is subsequently approved by the legislature, it will take effect the day after such approval.
