New law requires an arborist license for the purpose of obtaining any insurance required for
arborists. Further provides that failure to obtain the insurance required for arborists as
outlined in administrative rule LAC 7:XXIX.117(E)(2) constitutes a horticulture violation.
Existing law (R.S. 3:3810.2) provides the following civil penalties for horticulture violations:
(1) $500 per violation, if the person was not found guilty in a prior adjudication.
(2) $1000 per violation, if the person was found guilty in a prior adjudication.
(3) $1,500 per violation, if the person was found guilty in two or more prior adjudications.
(4) The commission may assess the costs of the adjudicatory hearing.
Effective August 1, 2024.
