Current law requires all peace officers to receive seven hours of training on human trafficking within one year of employment from the
Council on Peace Officer Standards and Training’s Online Learning Management System Program; requires all officers employed on
8/01/22, who have been employed for one year or more to receive 7 hours of training on human trafficking from the Council on Peace
Officer Standards and Training’s Learning Management System program by 12/31/22. Proposed law requires that in addition to human
trafficking training required in current law, all peace officers are required to receive three hours of in-person training on human trafficking
from an accredited law enforcement training center in the state; requires all peace officers employed on 8/01/24, who have been
employed for one year or more to receive 3 hours of in-person training on human trafficking from an accredited law enforcement training
center in the state by 12/31/24.

EXPENDITURE EXPLANATION
Proposed law will likely result in an indeterminable increase in Local Funds expenditures to municipalities, SGF to state law enforcement
agencies, and an increase in Statutory Dedication expenditures out of the Crime Victims Reparation Fund in the Louisiana Commission on
Law Enforcement (LCLE), to the extent that the 23,000 full time Louisiana peace officers, and the additional 6,000 to 7,000 part-time and
reserve officers complete the additional three hours of training requirements on human trafficking. Proposed law would require academy
training centers to conduct in-person training on human trafficking during the evening and on weekends to ensure compliance with the
proposed law’s deadline (12/31/24), considering the number of officers that would require training at the 28 law enforcement academy
training centers, the time commitment for academy training center staff to conduct the in-person training, and travel costs incurred by
municipalities located in geographical jurisdictions where there are no academy training centers.
Proposed law will likely result in municipal and state law enforcement agencies absorbing travel and labor costs for law enforcement
officers to attend and complete the in-person training. Several municipalities are not located near one of the 28 academy training centers
within the state, which will cause municipalities to incur costs (for three hours of training and travel) that were previously reimbursed by
the Louisiana Commission on Law Enforcement. The costs that would be absorbed by municipal law enforcement agencies are
indeterminable, as costs associated with travel and labor are variable.
LCLE has a policy of reimbursing every local government agency up to $500 for basic training of each of their full-time and part-time
peace officers out of the Crime Victims Reparation Fund, and these reimbursements are funded by collections of court fines and fees.
These collections are down by one-third from previous years, primarily due to offenders being referred to court diversion programs instead
of paying court fines and fees. Local Funds expenditures would likely exceed LCLE’s reimbursement revenue source, which allows for
reimbursements to local law enforcement agencies for those expenditures out of the Crime Victims Reparation Fund (the portion dedicated
by LCLE policy to reimbursement for P.O.S.T. training). For the past seven years, $868,040 has been collected annually from court fines
and fees, to address an annual average of $857,373 in expenditures (of which $390,538 represents the average annual reimbursements
made by LCLE for POST training). If LCLE were to reimburse local law enforcement agencies for costs incurred (up to $500 per officer) to
attend and complete the in-person training, the annual average of $390,538 in reimbursements would be reached for 781 officers
receiving a maximum reimbursement of $500 for completing the training under the proposed law (781 x $500 = $390,500). The
proposed law would require more than 23,000 peace officers to complete the in-person training, which would far exceed LCLE’s capacity to
reimburse the state and municipalities for travel and labor costs. LCLE advises that there are outstanding reimbursements of $91,635 for
2023, $246,600 for 2024, and a total of $338,235 in reimbursements through March 2024, that have not been paid.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.
