Provides for non-governmental agencies to receive background checks on contractors within the volunteer and employee
criminal history system. (8/1/24)
Present law allows certain businesses and organizations that provide care to children, elderly, or individuals with disabilities
to register with the bureau to obtain a state and federal criminal history report on individuals who have or seek to have
access to those children, elderly, or individuals with disabilities, to determine their suitability to be providing care to those
persons. Proposed law retains present law. Present law defines an "individual" as a person who has, seeks to have, or may
have access to children, the elderly, or individuals with disabilities, served by a qualified entity as (1) a person employed by
or volunteers with, or seeks to be employed by or volunteer with, a qualified entity or (2) a person who owns or operates, or
seeks to own or operate, a qualified entity. Proposed law retains present law and adds a person who contracts with, or seeks
to contract with, a qualified entity to the definition of "individual".

EXPENDITURE EXPLANATION
There is no anticipated direct material effect on governmental expenditures as a result of this measure.
REVENUE EXPLANATION
Proposed legislation may increase revenue to the statutorily dedicated Criminal Identification and Information Fund by an
indeterminable amount in FY 25 and subsequent years. The LA Bureau of Criminal Identification and Information within State
Police would perform the background checks for a fee of $39.25 for state and federal background checks that include
fingerprinting ($26 for state background checks and $13.25 for federal background checks, which State Police retains $2 of
the $13.25 fee charged for the federal background checks and remits the remainder to the Federal Bureau of Investigation).
The impact is indeterminable and is dependent on the number of entities that opt for a background check on contractors.
