House Bill No. [insert number] enacts R.S. 44:22.2, which establishes confidentiality provisions for records related to economic development negotiations conducted by local governments in Louisiana. Under this new law, records pertaining to active negotiations for projects aimed at retaining, expanding, or attracting businesses will be confidential if the involved party requests such confidentiality in writing and the local government's chief executive officer determines that disclosure would harm the negotiations. The chief executive officer must provide a written notice detailing the determination and publish general information about the negotiations on the local government's website and in its official journal within five days.

The bill also stipulates that confidential information cannot remain so for more than twelve months, with a possible extension of an additional twelve months if negotiations are still active and a new determination is made. However, no information can remain confidential for more than twenty-four months in total. The provisions do not apply to applications for licenses or permits or records related to hazardous waste negotiations. Additionally, the confidentiality provisions will expire on January 1, 2028.
