House Bill No. [insert number] enacts R.S. 44:22.2, which establishes confidentiality provisions for records related to economic development negotiations conducted by local governments in Louisiana. Under this new law, records pertaining to active negotiations for projects aimed at retaining, expanding, or attracting economic development will be confidential if the involved party requests such confidentiality in writing and the local government's chief executive officer agrees that disclosure would harm the negotiations. The chief executive officer must provide a written determination justifying the confidentiality, and the local government is required to publish a notice about the negotiations on its website and in its official journal within five days of the determination.
The bill also stipulates that confidential information cannot remain so for more than twelve months, with a possible extension of an additional twelve months if the negotiations are still active and the chief executive officer reaffirms the need for confidentiality. However, no information can remain confidential for more than twenty-four months in total. The provisions do not apply to applications for licenses or permits or records concerning hazardous waste negotiations. Additionally, the confidentiality provisions will expire on January 1, 2028.
