This bill enacts a new provision in the Louisiana Code of Criminal Procedure, specifically Article 985.3, which allows for the immediate expungement of criminal records under certain conditions. The court is granted the discretion to order this immediate expungement for individuals who have successfully completed a court-ordered probation or alternative sentencing program, provided they are otherwise eligible for expungement.
Additionally, the bill specifies that the expungement must utilize a designated form as outlined in Article 992 and mandates that the immediate expungement be served in accordance with Article 982. The documentation accompanying the expungement must include the court record with the signed order, the bill of information, sentencing minutes, and any relevant documents or records related to the arrest incident and plea agreements, if available.
