Provides for the financial security of surviving spouses and dependent children of deceased firemen in certain circumstances
Present law provides for payment of $250,000 to the surviving spouse, child, or another beneficiary of a fireman who suffers
death as a result of an injury arising out of and in the course of the performance of his official duties or arising out of any
activity in his capacity as a fireman in the protection of life and property. Proposed law includes any firefighter who is a
Louisiana resident and is employed by or under the control of one of the following federal agencies if the injury that resulted
in the death occurred in Louisiana: 1) Department of Defense, 2) Department of Agriculture, 3) Department of Veterans
Affairs, 4) Department of Interior, and 5) Federal Emergency Management Administration. Proposed law retroactively to
August 1, 2023.

EXPENDITURE EXPLANATION
This measure will result in an expenditure increase in the Office of Risk Management, in which survivor benefits would be
payable in the event of death for any firefighter who is a Louisiana resident and is employed by or under the control of one
of the following federal agencies: 1) Department of Defense, 2) Department of Agriculture, 3) Department of Veterans
Affairs, 4) Department of Interior, and 5) Federal Emergency Management Administration. This measure expands the
eligibility of firemen to receive the $250,000 survivor benefits allocated to the surviving spouse, child, or other beneficiary of
a fireman who suffers death as a result of an injury arising out of any activity in his capacity as a fireman in the protection of
life and property in Louisiana.
The Office of Risk Management (ORM) anticipates an expenditure increase of at least $250,000 in FY 25 for one (1) survivor
benefit. ORM is unable to determine how often a future benefit will be payable annually as a result of this measure, so the
cost is anticipated to increase but is indeterminable for the years thereafter. Pursuant to R.S. 39:1533(A)(2), ORM receives
a specific General Fund appropriation to pay such benefits on behalf of the Law Enforcement Officers and Fireman’s Survivor
Benefit Review Board. The provisions of this proposed law will be applied retroactively to August 1, 2023.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.
