Provides relative to electronic filings
Current law provides for the Louisiana Clerks Remote Access Authority (LCRAA), particularly its infrastructure, governance, procedures, technology, and
training to support a statewide portal for secure remote access by internet users to certain records maintained by the LCRAA; provides for certain
obligations placed on LCRAA to its members. Proposed law obligates the LCRAA to also provide maintenance and training to support a statewide portal with
a universal interface for secure remote access to records maintained by LCRAA; requires every clerk of court to facilitate electronic filing, recording, and
remote access through the portal by 1/01/26, and LCRAA to work with clerks of court to achieve this goal; requires every clerk of court to provide its case
management or docket system software and vendor used by each parish clerk of court, the number and percentage of remote filings of pleadings converted
to electronic images in each clerk of court, the capability and extent of the respective case management or docket systems to accept electronic signatures
by courts’ judges, and costs charged to process electronic filings and access, view, and download images of civil and criminal pleadings, electronic images
or paper copies of documents in the land title database, and electronic recording of documents effecting land titles; requires those who submit filings to
ensure private information is not included in filings; requires that on and after 1/01/26, all pleadings, documents, filings, and exhibits by an attorney be
delivered or transmitted electronically in accordance with a system established by a clerk of court or the LCRAA; removes the LCRAA board commissioner
appointed by the LA Bankers’ Association (reduces board of commissioners from 7 to 6 members); adds rules regarding filings electronically transmitted.

EXPENDITURE EXPLANATION
There is no anticipated direct material effect on governmental expenditures as a result of this measure.
The proposed law may result in an increased workload within the district clerks of court, as each will be required to provide information,
including its case management or docket system software and software vendor used by each parish court clerk, the number and
percentage of remote electronic and physical filings of pleadings converted to electronic image in each parish clerk of court, the capability
and extent of the respective case management or docket systems to accept electronic signatures by courts’ judges, costs charged by each
clerk to process electronic filings and access, view, and download images of civil and criminal pleadings, electronic images or paper copies
of documents in the land title database, electronic recording of documents affecting land titles, and establish a system whereby attorneys
transmit pleadings and other filings to the clerk of court or LCRAA by 1/01/26. To the extent the proposed law will result in an increased
workload in the district clerks of court or LCRAA, the LFO presumes that the clerks of court can absorb this anticipated workload using
existing staff and resources.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.
