The bill enacts R.S. 3:17.1, which establishes regulations for prescribed burning conducted by non-certified prescribed burn managers in Louisiana. It defines a non-certified prescribed burn manager as an individual who has not completed the certification program from the Louisiana State University Agricultural Center or another approved program. Before conducting a prescribed burn, these managers must notify the office of forestry with details about the burn and agree to adhere to smoke management guidelines. The commissioner of agriculture and forestry is granted the authority to create rules and regulations to implement this section.

Additionally, the bill specifies that prescribed burning under this section does not provide a rebuttable presumption of non-negligence for the non-certified managers. It also clarifies that the provisions do not apply to the burning of leaf piles, yard debris, or hand-piled natural vegetation. Violations of this section or related regulations may result in civil penalties, with fines of up to $250 for a first offense and up to $500 for subsequent offenses, assessed through an adjudicatory hearing process.
