The bill enacts R.S. 3:17.1, which establishes regulations for prescribed burning conducted by non-certified prescribed burn managers in Louisiana. It defines a non-certified prescribed burn manager as an individual who has not completed the certification program from the Louisiana State University Agricultural Center or another approved program. Before conducting a prescribed burn, these managers must notify the office of forestry with details about the burn and agree to adhere to smoke management guidelines. The commissioner of agriculture and forestry is granted the authority to create rules and regulations to implement this section.
Additionally, the bill specifies that prescribed burning under this section does not provide a rebuttable presumption of non-negligence for non-certified managers and excludes certain activities, such as burning leaf piles and yard debris, from its provisions. Violations of this section or related regulations may result in civil penalties, with fines increasing for subsequent offenses. The penalties are capped at $250 for a first offense and $500 for any subsequent offenses, and they can only be assessed following an adjudicatory hearing. The act will take effect upon the governor's signature or after the designated period for bills to become law without a signature.
