This bill enacts new provisions in the Louisiana Civil Code by introducing Articles 3493.11 and 3493.12, which establish prescriptive periods for tort actions. Specifically, Article 3493.11 sets a two-year liberative prescription for delictual actions, starting from the date the injury or damage occurs. It also specifies that this prescription does not apply to minors or interdicts in cases involving permanent disability related to product liability. Article 3493.12 addresses damage to immovable property, stating that the two-year prescription begins when the property owner becomes aware, or should have become aware, of the damage.
Additionally, the bill repeals existing Civil Code Articles 3492 and 3493 in their entirety, streamlining the legal framework surrounding tort actions. The provisions of this Act will only apply prospectively to delictual actions arising after its effective date of July 1, 2024.
