Provides relative to the crime of molestation of a juvenile
Current law delineates sentences for offenders who commit the crime of molestation of a juvenile, when the victim is 13 years of age or
older but has not yet attained the age of 17 as follows - for offenders with control or supervision of the juvenile, a fine of not more than
$10,000, or imprisonment for not less than 5 nor more than 20 years with or without hard labor, or both, without benefit of parole,
probation, or suspension of sentence; for offenders that are educators of juveniles, a fine of not more than $10,000, or imprisonment for
not less than 5 nor more than 40 years, with or without hard labor, or both, with at least 10 years of the sentence without the benefit of
parole, probation, or suspension of sentence. Proposed law increases the minimum sentence of imprisonment for offenders with control or
supervision of the juvenile, to not less than 10 years, with or without hard labor, and retains current law on the maximum sentence; adds
offenders in a position of supervision or entrusted with a supervisory role of the juvenile that includes, but is not limited to a religious,
charitable, scientific, educational, athletic, or youth serving purpose to the class of offenders with control or supervision of the juvenile to
whom current law applies.

There is no anticipated direct material effect on governmental expenditures as a result of this measure.
For informational purposes, the Department of Public Safety & Corrections - Corrections Services reports that there have been an average
of eight (8) admissions in the past two years (no admits in 2021) with an average sentence length of 19 years for those convicted of
molestation of a juvenile, when the victim is 13 years of age or older but has not yet attained the age of 17. Considering that the average
sentence imposed for those convicted is 19 years (longer than the proposed law which would only require 10 years of sentences to be
served without the benefit of parole, probation, or suspension of sentence), there would be no fiscal impact with the passage of the
proposed law.
REVENUE EXPLANATION
Proposed law will likely result in an indeterminable increase in local revenues as a result of convictions of molestation of a juvenile, when
the victim is 13 years of age or older but has not yet attained the age of 17. The exact fiscal impact of the passage of this legislation on
local revenue is indeterminable, as the fines that would be imposed on those convicted are variable in nature, and the number of fines that
will be imposed on offenders convicted of proposed law is unknown. The potential revenue will accrue to the local governing authority.
