Provides relative to birth certificates and state identification for children leaving custody of the office of juvenile justice
Current law requires that, at least six months prior to the release of a child, the Office of Juvenile Justice (OJJ) prepare a
written, individualized, and thorough transitional plan developed in collaboration with the child and any agency or
department assuming his custody or care. Proposed law requires the OJJ to ensure that a child has a certified birth
certificate and valid six-year identification card or submit all necessary applications, records, and fees to obtain those
records within thirty days from when a child is committed into the custody of the OJJ; requires OJJ to ensure that a child has
both a certified copy of the child’s birth certificate and valid state identification card upon release from custody, and that
failure to obtain these records shall not prevent a child’s release from custody.

EXPENDITURE EXPLANATION
Proposed law will increase OJJ expenditures by approximately $7,001 SGF in FY 25. Expenditures consist of $3,885
associated with securing IT personnel to establish OJJ offices as identification issuance locations and $3,115 associated with
securing birth certificates for juveniles in nonsecure custody. In future fiscal years, the office reports an annual increase of
$3,115 in SGF expenditures associated with providing birth certificates to youth in nonsecure custody. The cost is calculated
as follows:

Note: OJJ currently has policies and procedures in place to provide youth in secure custody with both birth certificates and
identification cards. Proposed law, if enacted, would have the effect of requiring that OJJ also ensure that youth in nonsecure
custody receive birth certificates and identification cards. Those youth in nonsecure custody are considered children in foster
care, which would qualify each of them for a waiver of costs associated with obtaining an identification card. Therefore, OJJ
would only incur costs related to ensuring youth in nonsecure custody receive birth certificates. The average number of
youth in nonsecure custody is 201 per year.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.
