Provides relative to access to birth certificates
Present law provides that a certified copy of a vital record in the custody of the vital records registry shall be issued in
accordance with regulations duly promulgated in accordance with the Administrative Procedure Act. Proposed law provides
that such a copy must also be issued in accordance with other provisions of law governing disclosure of records under
Title 40 of the Revised Statutes. Present law allows an attorney to request a copy of a vital record as a representative of a
party who is eligible to obtain such a copy themselves. Proposed law allows an attorney to do so even if the party is under
the age of eighteen. Proposed law requires the state registrar to accept and fulfill requests for birth certificates upon
submission of a written declaration and copy of credentials of the attorney, whether the request is submitted by the attorney
or by a nonlawyer employed, retained by, or associated with that attorney. Effective upon governor's signature.

EXPENDITURE EXPLANATION
There is no anticipated direct material effect on governmental expenditures as a result of this measure. The Louisiana
Department of Health (LDH) reports that the proposed law simplifies the process of obtaining a birth certificate for attorneys
by allowing them to send an associate or non-attorney employee to obtain the certificate on their behalf. LDH reports that
the proposed law also allows attorneys to request birth certificates for those persons that they represent who are under the
age of 18 without a release from the parents/legal guardian. LDH does not anticipate that proposed law will lead to an
increase in vital records requests.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure. LDH anticipates that the
proposed law will not result in additional birth certificate requests and therefore will not increase vital records fee revenues.
