This bill enacts new provisions regarding the sale and distribution of mitragynine speciosa, commonly known as kratom, in Louisiana. It establishes that no person shall sell or distribute products containing mitragynine speciosa to individuals under the age of twenty-one, with violations resulting in a fine of up to five hundred dollars, imprisonment for up to six months, or both. The bill also defines mitragynine speciosa as products containing either mitragynine or 7-hydroxy-mitragynine.
Additionally, the bill introduces a local option for governments to regulate or prohibit the sale and distribution of mitragynine speciosa products more stringently than the state law allows. Local governments, defined as parishes or municipalities, can enact ordinances to impose such regulations. Furthermore, the bill repeals Act No. 231 from the 2019 Regular Session, which previously addressed similar issues related to controlled substances.
