This bill enacts Chapter 25-A of Title 42 of the Louisiana Revised Statutes, which establishes policies to prohibit the use of certain applications, specifically the social networking service TikTok and its successors, on state-owned or leased computers, devices, and networks. The Office of Technology Services is tasked with developing this policy, which must be approved by the Joint Legislative Committee on Technology and Cybersecurity. Additionally, agency heads are responsible for ensuring compliance with the policy, and similar policies must be developed for the judicial and legislative branches.
Penalties are outlined for agency heads who fail to implement the policy, with civil penalties not exceeding $500 per violation, which they would be personally liable for. However, the bill allows exceptions for public servants to access the covered application for legitimate purposes, such as scientific or educational use, provided they receive prior approval from their agency. The provisions of this chapter do not apply to networks that are open and available for public access. The policy must be developed and submitted by August 23, 2023, and the act will take effect upon the governor's signature or after the designated period for bills to become law without a signature.
