This bill amends existing Louisiana law regarding child support by repealing the mandatory minimum child support award previously established in R.S. 9:315.14. It modifies R.S. 9:315.1(C) and 315.2(D) to allow courts greater discretion in determining child support amounts based on the combined adjusted gross income of the parties involved. Specifically, if the combined income is equal to or less than nine hundred fifty dollars, the court will determine child support based on earnings, income, and other evidence of ability to pay, rather than adhering to a fixed minimum amount. The bill also clarifies that the lowest basic amount of child support should not be construed as a limitation on the court's authority to deviate from the guidelines.
The bill introduces several new considerations for courts when determining child support, including the extraordinary medical expenses of a party, community debts, and the need for immediate support when a full hearing cannot be timely held. It emphasizes that the court may take into account the financial burdens associated with supporting an adult child with a disability. The provisions of this Act are set to become effective on January 1, 2024.
