The bill enacts a new law, R.S. 14:93.2.4, which establishes the crime of unlawful swimming in certain waterways in Louisiana. It specifically prohibits parents or legal guardians from allowing minors to swim in designated river areas without a proper personal flotation device (PFD) approved by the United States Coast Guard. This regulation applies to sections of rivers that flow from water-controlled structures to a point seventy miles downstream, particularly where these structures create reservoirs for hydroelectric power generation.
Penalties for violating this law are tiered based on the number of offenses. For a first conviction, the parent or guardian may receive a warning ticket or face a fine of up to twenty-five dollars. A second conviction could result in a fine of up to fifty dollars and possible imprisonment for up to seven days. For a third or subsequent conviction, the penalties increase to a fine ranging from seventy-five to two hundred fifty dollars and imprisonment for up to thirty days.
