Summary of Original VersionAmend KRS 61.878, relating to open records, to provide that law enforcement records shall be exempt from public inspection if the disclosure of the information could pose an articulable risk of harm to the law enforcement agency or its investigtion by revealing the identity of informants or witnesses not otherwise known.

Retain original provisions, except require records of law enforcement agencies compiled in the process of detecting and investigating statutory or regulatory violations to be exempt from public inspection if an agency states that the disclosure of information could pose a risk of harm to the agency or its investigation by revealing the identity of informants or witnesses not otherwise known; establish that unless exempted in whole or in part by other sections of the Kentucky Open Records Act or KRS 17.150, that records pertaining to law enforcement investigations are required to be open after the investigation is completed or a decision is made to take no action; exempt from public inspection records or information compiled and maintained by the Department of Law pertaining to criminal investigations or criminal litigation; amend KRS 17.150 to permit portions of intelligence and investigative reports maintained by criminal justice agencies to be withheld from inspection pursuant to the Kentucky Open Records Act.
