The bill amends the Agritourism Promotion Act by exempting certain registered agritourism operations from local code and regulation enforcement. Specifically, it prohibits cities and counties from enforcing building codes or other ordinances related to health and safety, property maintenance, and facility usage for nonpublic registered agritourism locations. A nonpublic registered agritourism location is defined as one where agricultural activities are the sole operations and the general public is allowed only by specific invitation. The bill clarifies that this exemption does not apply to locations that sell goods or services not produced on-site or where the public can access the property without an invitation.
Additionally, the bill amends K.S.A. 2025 Supp. 32-1432 by changing the definition of "agritourism activity" to specify that it includes activities accessible to the public only by invitation from the registered agritourism operator. The existing section of K.S.A. 2025 Supp. 32-1432 is repealed, and the new definitions and provisions are intended to enhance the protection and promotion of agritourism in Kansas. The act will take effect upon publication in the statute book.
