This bill amends K.S.A. 2025 Supp. 75-4379 to enhance the process of information sharing among law enforcement agencies regarding applicants for law enforcement positions. It mandates that hiring agencies require applicants to sign a written waiver allowing previous employers to disclose their files related to job performance and conduct. If an applicant refuses to sign this waiver, they will not be considered for employment. The bill stipulates that once a waiver is received, the previous agency must disclose the applicant's files within 21 days, with certain exceptions for binding nondisclosure agreements executed before July 1, 2018. Additionally, the bill clarifies that files obtained during the hiring process are not subject to public records requests directed at the hiring agency.
Furthermore, the bill introduces provisions requiring law enforcement agencies to report any information acquired during the hiring process that suggests an applicant may have committed a crime or engaged in conduct warranting licensing or certification sanctions. This information must be shared with relevant authorities, including the licensing or certifying authority and the agency where the applicant was employed at the time of the alleged conduct. The bill also defines key terms such as "files" and "early warning information," which are crucial for understanding the scope of the information that must be shared. The existing section of K.S.A. 2025 Supp. 75-4379 is repealed, and the new provisions will take effect upon publication in the statute book.
