This bill amends the woman's-right-to-know act by allowing plaintiffs who claim violations of informed consent requirements related to abortion to elect to limit their recovery to statutory damages of $5,000, along with any amounts they have paid in connection with the abortion and reasonable attorney fees. Additionally, if a plaintiff chooses to limit their recovery, the medical malpractice screening panel laws will not apply to their case. The bill clarifies that this provision does not affect actions brought under a specific section of the law, ensuring that those cases remain subject to the existing malpractice laws.

Furthermore, the bill amends K.S.A. 2025 Supp. 65-6708 to include the new provisions and repeals the existing section. The updated law will be known as the woman's-right-to-know act, which encompasses the new amendments. The act will take effect upon its publication in the statute book.
