The bill amends K.S.A. 21-5805 to expand the definition of unlawful acts involving theft detection shielding devices. It now includes the possession, with intent to commit theft, of a computer program, application, software, or other device that is designed to operate a lock on or start a motor vehicle without an ignition key or key fob, as well as those that can copy, store information related to, or interfere with these functions. The bill also clarifies that certain individuals and businesses, such as vehicle dealers, locksmiths, and law enforcement officers, are exempt from these provisions.
Additionally, the bill repeals the existing section of K.S.A. 21-5805, which indicates a significant update to the law regarding theft-related offenses. The violation of the amended section remains classified as a severity level 9, nonperson felony. The act will take effect upon its publication in the statute book.
