This bill amends the residential landlord and tenant act to require landlords to offer tenants the opportunity to purchase their dwelling units before listing them for sale to the public or third parties. Landlords must provide written notice to tenants detailing their right to make an offer, including material terms of the sale, and the notice must be delivered via first-class mail or a delivery service with tracking. Tenants have 30 days to submit an offer, and landlords must respond within five days, either accepting the offer or providing a counteroffer. If multiple tenants submit offers, the landlord can choose the most favorable one.
Additionally, the bill outlines that a tenant's right of first refusal is terminated if they do not respond to an offer or counteroffer. It specifies that landlords cannot accept third-party offers until they have complied with the notice and offer requirements. The bill also clarifies that certain transfers of title, such as those to family members or through court orders, are exempt from these provisions. Violations of this section are classified as deceptive practices under the Kansas consumer protection act, allowing for enforcement and remedies.
