This bill amends K.S.A. 20-3301 to enhance transparency and accountability in the appellate court system by requiring the clerk of the appellate courts to publish a monthly list of cases from the Supreme Court and Court of Appeals. The list will include cases where a decision has not been entered within six months of submission, as well as cases where a petition for review has not been granted or denied within the same timeframe. The published lists will contain essential details such as the case name, case number, submission date, and, for Court of Appeals cases, the panel of judges involved. This information will be made publicly available on the Supreme Court's website until the cases are resolved.
Additionally, the bill repeals existing provisions that mandated district courts to enter decisions on motions and non-jury trials within 120 days and outlines the process for counsel to request decisions if delays occur. The new language emphasizes the importance of timely decisions by the courts and establishes a framework for accountability, including the requirement for the chief judges to set intended decision dates when necessary. The act will take effect upon publication in the Kansas Register.
