This bill aims to protect the rights of unit owners in associations by prohibiting any deed, restrictive covenant, bylaw, rule, or declaration from limiting or prohibiting the installation of rooftop solar energy conversion systems. It establishes that unit owners have the right to install such systems on their rooftops without interference from their associations. However, the bill allows associations to adopt reasonable rules regarding the placement of these systems, provided that such rules do not prevent installation, impair functionality, restrict usage, or adversely affect the cost or efficiency of the systems.

Additionally, the bill clarifies that its provisions do not apply to common elements or limited common elements within a common interest community. This legislation is intended to be a part of and supplement the Kansas uniform common interest owners bill of rights act, ensuring that unit owners can utilize solar energy without undue restrictions from their associations. The act will take effect upon its publication in the statute book.
