Proposed guardians must complete an approved training program before their appointment, and the Secretary has the authority to suspend or revoke program approvals if they do not meet established criteria.
Additionally, the bill amends K.S.A. 59-30,149 to stipulate that if a proposed guardian is appointed for an adult with cognitive impairment, they must provide verification of their completed training program to the court. The court retains the discretion to waive this requirement if it is deemed in the best interest of the respondent. The existing section of K.S.A. 59-30,149 is repealed, and the new provisions are intended to enhance the qualifications of guardians and ensure better support for vulnerable adults.
