This bill amends the residential landlord and tenant act to require landlords to offer tenants the opportunity to purchase their dwelling units before listing them for sale to the public or third parties. Landlords must provide written notice to tenants, detailing their right to make an offer, the material terms of the sale, and any deadlines for submitting offers. Tenants have 30 days to respond with an offer, and landlords must either accept the offer or provide a counteroffer within five days. If multiple tenants submit offers, the landlord can choose the most favorable one.
Additionally, the bill outlines that a tenant's right of first refusal is forfeited if they do not submit an offer or accept a counteroffer. It specifies that landlords cannot accept third-party offers until they have complied with the notice and offer requirements. The bill also clarifies that certain transfers of title, such as those to family members or through court orders, are exempt from these provisions. Violations of this section are classified as deceptive acts under the Kansas consumer protection act, allowing for enforcement and remedies.
