This bill aims to limit the authority of cities and counties in regulating landlords' rental practices. It prohibits local governments from enacting ordinances that would restrict a landlord's discretion to refuse to rent residential or commercial properties based on a prospective tenant's income source, including housing assistance program funds, or their credit history, eviction records, or criminal background. Additionally, the bill allows landlords to determine the amount of security deposits and does not require them to extend a right of first refusal to tenants.
However, the bill does permit cities and counties to implement regulations that prevent discrimination against tenants or prospective tenants solely based on their receipt of veterans benefits. This provision ensures that while landlords have greater flexibility in their rental decisions, there is still a safeguard against discrimination for a specific group of individuals. The act will take effect upon its publication in the statute book.
