The bill prohibits the Secretary for Children and Families from adopting or enforcing policies related to the placement, custody, or appointment of custodians that may conflict with individuals' sincerely held religious or moral beliefs regarding sexual orientation or gender identity. Specifically, it prevents the Secretary from requiring individuals to affirm or support governmental policies that contradict their beliefs, or from disqualifying individuals from selection or licensure based on these beliefs. The bill also clarifies that the Secretary can still consider the religious or moral beliefs of a child and their biological family when making decisions in the child's best interest.
Additionally, the bill establishes a right of action for individuals who believe their rights have been violated under this section, allowing them to seek actual damages, injunctive relief, and attorney fees from the Department for Children and Families. The Department is also held liable for any violations committed by its contractors, although entities contracting with the Department cannot be sued for such violations. This legislation is intended to be supplemental to the existing Kansas code for the care of children and will take effect upon publication in the Kansas register.
