Additionally, hospitals are required to furnish patients with an estimate of their payment responsibilities for elective procedures, tests, or services upon request, provided the request is made at least three days in advance. Written information about the ability to request such estimates must be prominently displayed in public areas of the hospital and on their websites.
The enforcement of this act will be overseen by the attorney general, who is tasked with notifying hospitals of the new requirements before the act takes effect on July 1, 2025. If a hospital is found to be noncompliant, the attorney general will refer the case to the United States Department of Health and Human Services for further action. Notably, the bill removes provisions that allowed patients to file civil actions against hospitals for noncompliance, shifting the enforcement responsibility solely to the attorney general and federal authorities.
