The bill amends K.S.A. 44-1203 to increase the minimum wage for employees who receive tips and gratuities. It removes the previous minimum wage rate of $2.65 an hour prior to January 1, 2010, and the $2.13 minimum wage for tipped employees, replacing them with a new minimum wage of $6.15 an hour for those employees. The bill stipulates that if the combined total of an employee's tips and the minimum wage paid by the employer equals at least $7.25 an hour, no further payment is required. However, if the total is less than $7.25, the employer must pay the difference to ensure the employee receives at least that amount.

Additionally, the bill clarifies that the provisions do not apply to employers and employees covered under the federal Fair Labor Standards Act. The existing section of K.S.A. 44-1203 is repealed, and the act will take effect upon publication in the statute book.
