This bill amends K.S.A. 44-1203 to increase the minimum wage for employees who receive tips and gratuities. The previous minimum wage for such employees, which was set at $2.13 an hour, is raised to $6.15 an hour. Additionally, the bill stipulates that if the total of an employee's tips and the minimum wage paid by the employer equals at least $7.25 an hour, no further payment is required. However, if the combined amount is less than $7.25, the employer must pay the difference to ensure the employee receives at least the minimum wage.
Furthermore, the bill repeals the existing section of K.S.A. 44-1203, which included outdated wage rates of $2.65 an hour prior to January 1, 2010, and $7.25 an hour thereafter. It also clarifies that the provisions do not apply to employers and employees covered under the federal Fair Labor Standards Act. The act will take effect upon its publication in the statute book.
