This bill amends the Kansas Code for Care of Children by reducing the maximum duration for which a custodian can place a child in the custody of the secretary in a secure facility from 60 days to 45 days. Additionally, it eliminates the option for courts to extend this authorization for two additional periods of up to 60 days each. The bill also includes provisions for the court to hold a preliminary hearing within 24 hours of a child's custody and an evidentiary hearing within 72 hours to determine if the child has violated a court order.
Furthermore, the bill specifies that the secretary will only pay for the placement and services of a child in a secure facility if there is a valid court order authorizing such placement. It also clarifies that nothing in this section allows for the placement of a child in an adult jail or lockup. The existing section of K.S.A. 38-2260 is repealed, and the act will take effect upon publication in the statute book.
