This bill amends the Kansas Code for Care of Children by reducing the number of days a custodian may be authorized by the court to place a child in the custody of the secretary in a secure facility from 60 days to 45 days. Additionally, it eliminates the option for the court to extend this authorization for two additional periods of up to 60 days each. The bill also includes provisions for the court to hold a preliminary hearing within 24 hours of a child being taken into custody and mandates an evidentiary hearing within 72 hours to determine if the child has violated a court order.

Furthermore, the bill specifies that the secretary shall only pay for placement and services for a child in a secure facility upon receipt of a valid court order. It also clarifies that nothing in this section authorizes the placement of a child in an adult jail or lockup. The existing section of K.S.A. 38-2260 is repealed, and the act will take effect upon publication in the statute book.
