This bill amends K.S.A. 65-166a to extend the expiration period for permits issued under the water pollution control permit system from five years to ten years. It allows the secretary of health and environment to issue permits for terms of less than ten years if valid cause exists. Additionally, the bill includes provisions for the assessment of fees related to the permits, which are based on various factors such as the quantity of waste discharged and the capacity of treatment facilities. The bill also specifies that fees for permits required for the extension of sewage collection systems will not be assessed, while fees for other treatment devices and discharges will be nonrefundable.
Furthermore, the bill modifies the requirements for confined feeding facilities, stating that permits will be required for facilities with an animal unit capacity of 999 or fewer if they pose significant water pollution potential, as well as for those with a capacity of 1,000 or more. The annual permit fees for these facilities are also outlined, with specific maximum amounts based on their capacity. The bill repeals the existing section of K.S.A. 65-166a and establishes that all fees collected will be remitted to the state treasurer for deposit into the water program management fund.
