Dear Representative Francis:
SUBJECT: Fiscal Note for HB 2743 by House Committee on Transportation
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2743 is
respectfully submitted to your committee.
HB 2743 would prohibit a person’s driving privileges or driver’s license from being
suspended due to nonpayment of fines or court costs associated with a traffic citation. The bill’s
provisions would apply retroactively to a person whose driver’s license was suspended prior to
July 1, 2024, due to nonpayment of fines or court costs associated with a traffic citation.
The Office of Judicial Administration states the bill would have a fiscal effect on Judicial
Branch operations, if enacted. According to the Office, the current case management system
would need to be reprogrammed, which would result in additional expenditures. Because the bill’s
provisions would apply retroactively, the Office indicates this would increase the workload for
district court clerks and Office staff. Additionally, the Office states Judicial Branch staff would
have to find an alternative solution and implement it to comply with the bill’s provisions until the
reprogramming is completed. The Office indicates enactment of the bill could result in a decrease
in revenue from traffic court costs and fines, which would have been credited to the State General
Fund and other state funds.
Since the bill would prohibit suspension of an individual driver’s license for failure to pay
traffic citations and retroactively reinstate those licenses that are currently suspended, the
Department of Revenue indicates the $100 reinstatement fee would no longer be collected on those
suspensions. Of the $100 reinstatement fee, 29.41 percent is credited to the Division of Vehicles

Operating Fund, which could result in a decrease in the amount collected. Any fiscal effect
associated with HB 2743 is not reflected in The FY 2025 Governor’s Budget Report.
