Dear Representative Williams:
SUBJECT: Fiscal Note for HB 2718 by Representative Osman, et al.
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2718 is
respectfully submitted to your committee.
HB 2718 would change current law regarding school district open enrollment. The bill
would eliminate school district open enrollment requirements that were enacted by the 2022 and
2023 Legislatures and would allow districts to determine nonresident student enrollment.
The Department of Education reports that the enactment of HB 2718 would have no fiscal
effect on statewide calculations for state aid to school districts. The bill could change a district’s
nonresident enrollment numbers; however, the fiscal effect on individual school districts cannot
be estimated. In addition, the Department states that the bill would remove school district reporting
requirements that are in current law. However, the fiscal effect for the reduced administrative
requirements for the Department cannot be estimated.
The Kansas Association of School Boards reports that the enactment of the bill would
revert districts to prior nonresident student enrollment policies. There would be fewer
administrative costs with these prior policies than with the current open enrollment statutes;
however, a fiscal effect cannot be estimated.
