Dear Representative Thomas:
SUBJECT: Fiscal Note for HB 2709 by Representatives Martinez and Melton
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2709 is
respectfully submitted to your committee.
HB 2709 would establish Fentanyl Poisoning Awareness Week for each public school in
grades six through 12. The State Board of Education would be required to designate a week each
school year as fentanyl poisoning awareness week and develop statewide standards on age-
appropriate instruction on prevention and abuse of these drugs. The Board would be required to
distribute these standards to each school district.
The local board of education of each district would be required to adopt policies and
procedures that would align with the Board standards to provide instruction to students in grades
six through 12. Instruction during awareness week would include: (1) prevention of the abuse of
and addiction to fentanyl and other opioids; (2) awareness of school and community resources
available to help with abuse and addiction and how to access resources; (3) education on over-the-
counter opioid antagonist medications and how these are administered; and (4) health education,
including information on general substance use and abuse and youth substance use and abuse. The
local board of education may provide instruction as part of any other drug abuse awareness and
prevention program provided by public or private third-party organizations or law enforcement
agencies.
The Department of Education indicates that the required additional administrative
requirements for this bill by itself would be performed by existing staff of the agency. However,
if the combined effect of implementing this bill and other enacted legislation exceeds the
Department’s administrative resources, additional expenditures for administrative costs beyond

the Department’s current budget in future years may be required. In addition, the agency would
require expenditures totaling $3,000 from the State General Fund in FY 2025 and in future fiscal
years for printing and distribution costs of materials for the Fentanyl Poisoning Awareness Week.
Any fiscal effect associated with HB 2709 is not reflected in The FY 2025 Governor’s Budget
Report.
The Kansas Association of School Boards reports that the enactment of the bill would
likely result in school districts experiencing costs associated with implementing a new curricular
program. However, a fiscal effect cannot be estimated.
